Default ABS light on at start up (Intermittent)

Hi Guys i have a 2003 jdm blobeye sti having trouble with my ABS

when i turn the ignition on the ABS light doesn't go out even when turning the key so engine running. but if i shut the engine off then turn ignition back on the light goes out.

or even turn the ignition on then off again the light goes out?

Have ABS CODE 44

Things i have done.
replaced battery
checked and cleaned on ABS unit in engine bay.
Checked fuse box under dash.

its really doing my head in any advice would be great.
