The shortened story.... Bloke in Caterham is hit on track by bloke in Civic, claims off his track insurance, Caterham insurers take Civic driver to court (who didn't have track cover), judge makes Civic driver pay for the insurers payout.

Just spent half an hour reading that thread. Hope the guy takes it to appeal and the county court decision is overturned, or the insurance company review their actions and drop it.

Does not set a good precedent re: 'negligence'. How long before we have the same issues as the Nurburgring regarding dropped fluids and personal injury? At the very least, it lets people think they have a chance of getting money back after an incident with these damn 'no win no fee' solicitors and people start getting dragged through the courts.

I sodding well hope not.

Errr.... the fact that trackday cover includes no third party liability and everyone signs a disclaimer before a trackday stating the the driver is responsible for any damage to their vehicle, despite who might cause it. Same logic applies for personal injury, you cannot hold a third party liable.

If this court judgement is upheld, then the above disclaimer is pretty much worthless and it opens the door to a lot of claims that could kill off trackdays......

Right - now the original post makes sense for the 97.2%* of people who don't drive on tracks then. Ta.

* 47.6% of all the statistics I quote are made up on the spot.
