Spoke to trading standards and they think i have a case. I have have the old advert from auto trader which advertises the car as having done 70k, and i can say hand on my heart that that was around the mileage i was looking for on the car i wanted to buy. obviously i accept that the engine and turbo could have failed at lower or higher miles but i do feel he should have checked the mileage before before putting that in the advert and i would not of even went to birmingham to look at the car.
He told me on the day that it was a solid car that has belonged to his friend and had just been serviced etc, the car was up for 3,900 and when i made him an offer we agreed that there would be no 3 month warranty(doh) and he would sell for 3,600,
I had the turbo fail within 3 months and now i need to get a new engine or a rebuild and i would not have said a word, but when i found out it has inaccurate mileage and i was not warned of that i feel a bit cheated to be honest.
Yesterday the garage said they had done no wrong and that was that. Today he called and said he still thought they were in the right but would offer £260 compensation as a good will gesture. Trading standards have told me to write to him and say I should possibly get a refund minus usual wear in tear (6 months) or for him to replace my car with a like for like car. They say this is because the car was mis advertised and there fore i was mis sold the car. The point is that the advert said 70k miles, regardless of any disclaimer on the bottom of the sale receipt.
I went to a trader as i had limited knowledge with cars and this looked like a reputable garage to buy from who i could trust, when the turbo failed i accepted it and replaced it, when the engine died again i accepted it and was ready to scrap or break the car as i cant afford to borrow the money needed to repair it. it took me about 5 years of buying sheds to build up 4 grand to spend on a scooby and now ive probably lost the lot so im pretty f£$ked off.

The car was motd in 2009 with 91k and a year later with 70k???
you can go on motoinfo.co.uk and check all the old mots and see theres a problem in about 2 minutes. Surely he could of done that.
Maybe im going a bit ott, but buses and walking a really starting to give me the hump.....
