My M3 RIP
 
Well i went all the way to Sandwhich today to take a look at my M3
I have to say some of it was worse than i thought and some was not as bad.
Whole car was wrapped in plastic so had to pull it off in places to get some pics, but i think you get the idea!!

At leasty 5 air bags should have gone off, and not one did, i am writting to BMW and also seaking advice against claiming my furkin damages against garage servicing the vehicle.

You are very LUCKY mate. BMW need to see these pic's. There is an issue as to why the airbags havent been deployed. Needs following up big time.

Looks as if the seat acted as a very basic roll cage.
As Nige says BMW need to see that- no airbags activated is very worrying.

2nd that, I'm boiling just thinking about it and it wasn't my car or accident. BMW need to compensate you for that big time, and have allot to answer for.

Have to say though.. looking at that roof line, if the drivers airbag had deployed it might have pushed you back in the seat and your head and neck/spine would have been squashed if it did. That roof line is scary and that was very,very close to being a fatal accident. Lucky is a an understandment.

The more i look at the pictures the more angry i get about the air bags, but as you all say , i am one lucky fooker.

I'm not sure who would be your first port of call.

The Garage you bought the car from or BMW Direct.

To that end, I would send it to both parties. I would also send a copy of the letter to your solicitor if you have one, signed and dated exactly as the other 2 letters.

What you must do is get the pictures printed and sent with all of the letters. And don't hold back with how angry you feel about what happened (or didn't).

Fianlly mate, as you know, I print lots of materials for the countries biggest Law College. One thing I print is something called Statutory Extracts of Law. This basically outlines most laws and gives examples etc. If thing get stuck, talk to me and we can consult this for details / angles.

I will also get my mum to draft the letter as she was legal secretary for about 40 yrs,she has contacts.
I am thinking i should notify my insurance company that i do not want the car desposed of,as i am taking legal advice.

They sorted the problem of the cracking rims.

Might get some fencing put up also like they have in the New Forest.

I would put a well constructed letter but firm together to your local BWM dealer and BMW UK GB, outlining your dissapointment and anger and seek for compentation and contact with 14 days of writing before you take matters further and seek legal reprensation.

If BMW have any sense they will get back to you quickly with a very nice letter and an offer, and if all things considered you are happy take the money and run.

Etiher that or any of the many personal injury guys would probably love to take up your case.!

I would go straight to BMW direct, it's not really any fault of the selling dealer. Go straight to the top!!!

blimey Martyn, that looks a mess. Can only re-iterate what others have said - lucky chap to not have much worse injuries.

However, i can kinda see why some of the airbags didn't deploy - they only work if the sensors register a big impact in that location surely? and the major damage is all in the roof where there would be no sensors?

but yeah, lucky fella :doubleup:
